1. Agreement to Terms
By accessing or using StakeLink (the “Service”), available at stakelink.app and any associated subdomains, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and StakeLink (“we,” “us,” or “our”). We reserve the right to update these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of those changes.
2. Description of Service
StakeLink is a social prediction game that allows users to create predictions, share them with friends via unique links, and track outcomes using entirely fictional in-game currencies. The Service is designed purely for entertainment and social engagement. StakeLink does not involve real money, real-money gambling, or any form of wagering with monetary value. All currencies, tokens, balances, stakes, and point systems within StakeLink are fictional constructs with absolutely no real-world monetary value.
The Service operates through shareable links that allow participants to make predictions without downloading an application or creating an account. Registered users may create predictions, manage groups, and track their prediction history. Anonymous participants may make picks via shared links using session-based identification.
3. Eligibility
You must be at least thirteen (13) years of age to use the Service if you reside in the United States. If you reside outside the United States, you must meet the minimum age requirement established by the laws of your jurisdiction. By using the Service, you represent and warrant that you meet the applicable minimum age requirement and that you have the legal capacity to enter into these Terms. If you are under the age of eighteen (18) or the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. User Accounts
To access certain features of the Service, you may create an account by providing a valid email address, a display name, and a password. Your account is authenticated through session-based cookies, and you are responsible for maintaining the confidentiality of your session and account credentials. You agree to provide accurate and complete information when creating your account and to keep this information up to date.
You are solely responsible for all activity that occurs under your account or session. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.
Participants who access predictions through shared links without creating an account are identified by anonymous session identifiers. These anonymous sessions are subject to the same rules of conduct described in these Terms.
5. Prohibited Conduct
You agree not to engage in any of the following prohibited activities while using the Service:
- Harassing, threatening, intimidating, or bullying other users
- Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity
- Manipulating predictions, outcomes, or voting through the use of multiple accounts, automated scripts, bots, or any other deceptive means
- Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service
- Interfering with or disrupting the integrity or performance of the Service, its servers, or connected networks
- Attempting to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service
- Using the Service for any illegal or unauthorized purpose, or in violation of any applicable local, state, national, or international law
- Posting or transmitting content that is obscene, defamatory, or promotes violence or discrimination
- Collecting or harvesting any personally identifiable information from the Service without authorization
- Using the Service to distribute unsolicited commercial messages (spam)
- Attempting to sell, trade, or exchange in-game currencies, balances, or any other virtual items for real-world money, goods, or services
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these prohibitions, including without limitation removing offending content, suspending or terminating the offending user’s account, and reporting the user to law enforcement authorities.
6. Intellectual Property
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, and the design, selection, and arrangement thereof) are owned by StakeLink, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
By submitting predictions, comments, or other content through the Service, you grant StakeLink a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and create derivative works from such content in connection with operating and providing the Service. You retain ownership of any intellectual property rights that you hold in the content you submit.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. STAKELINK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. STAKELINK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM STAKELINK OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STAKELINK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
Because StakeLink involves only fictional currencies with no real-world monetary value, no real financial loss can result from the use of the Service. All in-game balances, stakes, winnings, and losses are purely fictional and exist solely for entertainment purposes.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
You may delete your account at any time through the Service settings. Upon account deletion, we will remove your personal information in accordance with our Privacy Policy, though certain anonymized or aggregated data may be retained.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Delaware for the resolution of any disputes arising out of or relating to these Terms or the Service.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days’ notice prior to any new terms taking effect by posting the updated Terms on the Service and updating the “Last updated” date at the top of this page. We may also notify registered users of material changes via email. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.
12. No Real-World Value
All in-game currencies, tokens, stakes, and balances have NO real-world monetary value and cannot be redeemed, exchanged, sold, or transferred for real money, goods, or services of any kind.
StakeLink’s virtual currencies exist solely as a scoring and entertainment mechanism within the Service. They are not cryptocurrencies, digital assets, securities, or financial instruments of any kind. No conversion rate exists between any in-game currency and any real-world currency. StakeLink has no obligation to provide any refund, exchange, or compensation of any kind for in-game currencies, regardless of the reason for account termination or service discontinuation. Any attempt to sell, trade, or assign in-game currencies outside of the Service is a violation of these Terms and may result in immediate account termination.
